You are dead right David; I saw it in a forum in an Australian magazine I think (a long time ago and probably the details are wrong)

I recall some of the panel saying things like “the laws don’t allow adjustment but we tell him not to do it again” which sounds incompatible to me (“its Ok but its not Ok”)

I fully agree with the actual ruling. Although it looks like an example of fairness and common sense trumping pedantry
